For a corporation or LLC to obtain this exemption, it first needs to be registered with the Florida Department of State. The candidate must be listed as an officer or shareholder in the institution’s records.
Candidates in the Construction Industry:
Corporations and LLC:
• The candidate must possess at least 10% of the company’s shares which must be proven by a shareholder certificate. In the case of an LLC, it can be proven either with a shareholder certificate or by a notarized statement confirming ownership of at least 10%.
• Only three officers of a corporation or group of affiliated companies (including LLCs) may choose to be exempt.
• If the company is not a construction company, there is no limit to the number of employees eligible for exemption.
• Construction company waivers are valid for a period of two years or until a notice of revocation is received from the Division of Corporations.
• Validity and validity dates are listed on the Exemption Election Certificate.
Candidates from other industries:
• The candidate must be listed as a corporation officer in the Florida Department of State records.
• For corporations, there is no limit on the number of employees eligible for exemption.
• In the case of LLCs, 10 members may choose to be exempt.
• Exemptions from construction companies are valid for a period of two years or until a notice of revocation is received from the Division of Corporations.
• Validity and expiration dates are listed on the Exemption Election Certificate.
Once the application is submitted, the Division of Corporations will have 30 days to review your application to determine if the applicant meets the eligibility requirements for exemption. A Division of Corporations will:
• Issue a Worker’s Compensation Exemption certificate, which will be mailed to the address indicated in the application.
• Notify you by email if your request is incomplete.
• Let you know if the application has been rejected, in which case the candidate must submit a new Worker’s Compensation Exemption application.
